PERSONAL DATA
Placing an order requires an account containing personal data (name, address, telephone number, email, etc.). This data is stored on our website, and we undertake to disclose it only to third parties involved in processing your order (the bank and delivery service).
Under French Law No. 78-17 of 6 January 1978 on information technology and civil liberties, you have the right to access and correct your personal data at any time. You may exercise this right by emailing contact@ecu-racing.com.

TERMS OF USE
This service is intended strictly for personal use. Any reproduction or public display, in whole or in part, for other purposes and in any medium is prohibited. Failure to comply with this prohibition constitutes infringement and may give rise to civil and criminal liability. The information provided through this service is non-contractual and subject to change without notice. The specifications and availability of the products and services mentioned on this website apply to mainland France.
INTELLECTUAL PROPERTY
All elements of this website, of any kind, are protected by the French Intellectual Property Code and trademark law. Any use or reproduction requires prior authorisation, which must be confirmed in writing.
The ECU RACING brand and logos have been registered with INPI.
All logos and trademarks appearing on this website belong to their respective owners.
FRENCH LAW
ECU RACING guarantees the confidentiality of the information you provide. Right of access to computerised records: any user who has submitted information that directly or indirectly identifies them may request access to that personal information and have it corrected where necessary, in accordance with French Law No. 78-17 of 6 January 1978 on information technology, data files and civil liberties.
All products and services offered on this website comply with applicable European regulations. In the event of a dispute, French law alone applies.
Shipping policy
Once your order is confirmed, we will send you an express shipping label. Please pack your parcel carefully using bubble wrap. After receipt, we will modify the vehicle’s performance and test it on our equipment. For this work, we collaborate exclusively with an Official CFMOTO Dealer. Once the tests have been approved, we will return your ECU by express delivery.
RIGHT OF WITHDRAWAL, RETURNS AND REFUNDS
The following terms apply to distance orders placed by consumers. ECU RACING distinguishes the purchase of a new ECU from the tuning of an ECU already owned by the customer.

PURCHASE OF A NEW ECU
The purchase of a new ECU supplied and programmed by ECU RACING, including the VMAX OFF or Stage 1 configurations offered in the catalogue, is a sale of goods.
You have 14 calendar days from receipt to inform us of your decision to withdraw, without having to give a reason.
You may send your request to contact@ecu-racing.com, stating your order number. Any statement clearly expressing your wish to withdraw is accepted.
After notifying us, you have a further 14 days to return the ECU by post. We will provide return instructions and the return address. You are responsible for the direct return costs if you change your mind.
The product must be carefully protected and returned with the supplied accessories. You may handle it as necessary to establish its nature, characteristics and functioning. Any loss in value caused by handling beyond these checks may result in a justified deduction. No flat-rate restocking fee is charged.
We refund the product price and the original standard delivery costs. Any supplement for a more expensive delivery option chosen by the customer is not refunded.
Refunds are made without undue delay and no later than 14 days after notification of your withdrawal, using the same payment method unless you expressly agree to another method at no cost. The refund may be withheld until we receive the product or proof of dispatch, whichever occurs first.
An exchange may also be arranged subject to product availability, without limiting your right of withdrawal.

TUNING OR REMAPPING YOUR ECU
When you entrust your own ECU to ECU RACING, your order is for a service.
In principle, you have 14 calendar days from conclusion of the contract to exercise your right of withdrawal.
Any work before the end of this period requires your express request to start early. You must also acknowledge that your right of withdrawal will end once the service has been fully performed.
If you withdraw before the service begins, the amounts paid will be refunded.
If the service has begun at your express request and you have received the legally required information, only an amount proportionate to the work performed up to your withdrawal request is payable. No automatic 20% deduction applies.
Once the service has been fully performed with your prior express consent and your acknowledgement of the loss of the right of withdrawal, you can no longer request a refund simply because you have changed your mind.
If the required consent or information is missing, the consumer’s statutory rights continue to apply.

DEFECTS, NON-CONFORMITY AND GUARANTEES
These terms do not limit applicable statutory guarantees or your remedies if a service has been performed incorrectly.
For a defective or non-conforming product, contact contact@ecu-racing.com. ECU RACING covers the necessary return costs under the statutory guarantee of conformity.
POSTAGE COSTS
Postage costs within mainland France are calculated according to the total weight of the order. They are shown in the basket and are subject to the customer’s agreement when confirming the order.
DELIVERY CHARGES:
Delivery charges are calculated as accurately as possible by CHRONOPOST and COLISSIMO according to the weight and destination of your parcel. The amount is shown in the basket and depends directly on the carrier’s rates in force when you place your order. Orders containing several products may be split into multiple parcels, without affecting the delivery charges for your order. For logistical reasons, ECU RACING reserves the right to change the carrier for your order; you will be informed immediately.
RECEIPT OF YOUR PARCEL:
To avoid disputes, please always pack your parcel carefully using bubble wrap. We will not be responsible for damage to an ECU that has not been carefully packed.
Protection of tuning work and business purchases
ECU RACING tuning work is carried out by us. Purchasing a tuned ECU or an ECU remapping service does not transfer any intellectual property rights held by ECU RACING.
Subject to exceptions provided by law, reproducing or distributing protected elements of our tuning work for commercial purposes, including tuning other ECUs or selling copies of files, requires our prior written authorisation.
For online orders, consumer status depends on the actual purpose of the purchase. An order placed for business purposes does not qualify for the right of withdrawal reserved for consumers merely because the buyer declares themselves to be a private individual.
These provisions do not allow refunds to be refused automatically. The return and withdrawal terms detailed above apply according to the nature of the order, in compliance with applicable guarantees and statutory rights.
